Terms of Service

Effective date: October 10, 2026

Welcome to OmyShift (the "Service"), provided by OmyShift ("we", "us"). By downloading, installing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service. If this English version differs from the Traditional Chinese version, the Traditional Chinese version prevails.

1. The Service

The Service provides shift scheduling, rotation patterns, leave records, income estimates, reminders, image export, and backups. After signing in, you can sync between devices and share your schedule with people you choose.

We may add, change, or discontinue features to improve the Service. Before discontinuing a feature that affects your data, we will try to notify you in the app in advance so you have time to export your data.

2. Accounts

• You can sign in with Apple or Google. Please keep those accounts secure. Actions taken through your account are deemed to be your own.
• Users under 18 should use the Service and purchase Pro only with the consent of a parent or legal guardian.
• You can delete your account in the app at any time. Cloud data cannot be recovered after deletion.

3. Your data

You own the schedules and other content you create in the Service. We process that content only as needed to provide the Service, as described in the Privacy Policy.

Please use the app's backup feature regularly. In guest mode your data exists only on your phone and may be unrecoverable if your phone is lost or damaged or the app is deleted.

4. Sharing and acceptable use

You decide whom to share your schedule with and are responsible for making sure the shared content is appropriate. When using the Service, you must not:

• infringe the rights of others, or include illegal, harassing, discriminatory, or sexual content in display names, notes, or other content;
• impersonate anyone;
• use automated means to create data in bulk, attack or disrupt the Service, or attempt unauthorized access to the Service or other users' data;
• reverse engineer the app, except where expressly permitted by law.

If you violate these rules, we may remove the content, remove sharing relationships, or suspend or terminate your account. You can report violations through the in-app report feature or by email.

5. Pro

• Pro is available as a monthly subscription, a yearly subscription, or a one-time purchase. Prices are as shown in the App Store or Google Play.
• Payment is processed by Apple or Google and charged to your store account when you confirm the purchase.
• Monthly and yearly subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your store account will be charged for the next period within 24 hours before the current period ends.
• To manage or cancel: on iPhone, go to Settings > your name > Subscriptions; on Android, go to Google Play > profile icon > Payments & subscriptions > Subscriptions. After canceling, you keep Pro until the end of the paid period.
• Refunds are handled under Apple's or Google's refund policies. Please request them from the store.
• When you change phones or reinstall, use "Restore purchases" in the app with the same store account you purchased with.
• The one-time purchase gives you access to the Pro features available at the time of purchase for as long as the Service is offered. It is not a guarantee that the Service will exist permanently.

6. Disclaimers

• Income, overtime pay, and leave balance calculations are estimates for reference only. They may differ from actual amounts due to your settings, employer policies, or changes in law, and are not legal or employment advice. Your employer's payslips, your employment contract, and official interpretations by the authorities prevail.
• Shift reminders and push notifications depend on your phone's system and network and may be delayed or not delivered. Do not rely on them as your only reminder.
• The Service is provided "as is". We work to keep it stable and your data secure, but cannot guarantee that it will be uninterrupted or error-free.
• To the extent permitted by law, we are not liable for indirect damages arising from the use of or inability to use the Service. Where we are liable by law, our total liability is limited to the amount you paid for the Service in the 12 months before the incident. This limit does not apply to damages caused by our intentional misconduct or gross negligence.

7. Intellectual property

Except for content you create, the software, design, icons, and text of the Service belong to us or their respective owners. We grant you a personal, non-commercial, non-transferable right to use the Service on your devices.

If you download the app from the Apple App Store, Apple's Standard License Agreement also applies. If the two conflict, these Terms prevail, except for the provisions of Apple's agreement concerning Apple's rights.

8. Termination

You can stop using the Service or delete your account at any time. If we decide to shut down the Service, we will announce it in the app at least 30 days in advance so you have time to export your data.

9. Changes to these Terms

We may update these Terms and will update the effective date on this page. We will notify you in the app of significant changes. Continuing to use the Service after changes take effect means you accept the updated Terms.

10. Governing law and jurisdiction

These Terms are governed by the laws of Taiwan (R.O.C.). Disputes arising from these Terms are subject to the Taiwan Taipei District Court as the court of first instance, unless the law provides for exclusive jurisdiction elsewhere.
